- The US Supreme Court on Monday upheld the use of midazolam, a controversial lethal injection drug, saying that petitioners didn’t adequately prove that it violated Eighth Amendment protections against cruel and unusual punishment.
- The decision means states can continue using midazolam in their executions.
- The case came about after Oklahoma botched the execution of Clayton Lockett, who appeared to groan and struggle for 43 minutes after the state injected him with lethal injection drugs.
